is the dialogue we have with the incoming obama administration. i began my longest conversation with them at the agency, something along the lines of i think we have already done what you have done. it is appropriate in the new circumstances. it did not hold. all american detainees under any agent of the american government have to be treated with the army field manual. it was proved in september 2006. i would suggest the casual manual was written with the knowledge that there was option b. that this program was also available. now we are left with this option a. it should not concern you. before you get to interrogation, you have to capture and we do not capture. we have made it so legally difficult and so politically dangerous to capture that it seems to the outside looking in that the default option is to take the terrorists off the battlefield in another way. >> could you talk a bit about what obama inherited? we had moderate sleep deprivation. tummy slap. a diet of liquid ensure. i'm sure the product owners would love to hear that is torture. back. another story developing today. the obama administration provise posed revised rules to be exempt from free contraception as part of the health insurance plans. white house correspondent kristin welker joins us now. we got the heads up from the first read team this is coming down and now official word. what's the proposed change here? >> reporter: well, tamron, the bottom line is that employers now only need to meet one requirement to be considered a religious employer as compared to four. which was the initial proposal so as you pointed out it makes it easier for employers to be considered religious. this represents a compromise to some extent on the part of the obama administration. they are allowing employers to opt out of that provision that would basically provide contraceptive coverage to employees. at the same time allowing employees to get that coverage without paying a co-pay by dealing directly with the insurance company. the details of who shoulders this cost still a little bit murky but that really is the compromise that has been hammered out. here's what white

authorizing. you mentioned border security. it was the obama administration that sued arizona because they were trying to enforce border security. it's i.c.e. agents that have sued its its because they can't do their job. that is pre-condition to work through the status and it solves the problem. that is a fair compromise and good way to proceed. >> sounds like we have agreement here. we think border security has to have preconditions. >> i agree but finally these 11 million people is first step to border security, then we can separate the people that want to build the country to the people that want to harm this country. we need their fingerprints we know who they are. that is the first step. everybody agrees we need to do something about it. >> the immigration proposals, came through president bush and was defeated by senator barack obama. so that is number one. number two, i don't think the way phrasing it works. i think you have to guarantee border security and then i can have -- you can have it in place the status what will happen to the people here, but the question do we have r
